Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern the sale of products through the Bakers’Tricks® website, available at bakerstricks.com.
The website is operated by Antoine Hernandez, a sole proprietor, whose registered address is 4 avenue Blaise Pascal, 77420 Champs-sur-Marne, France, registered under SIRET number 837 733 666 00023.
Any order placed through the website constitutes the customer’s full and unconditional acceptance of these Terms and Conditions.
Article 1 – Purpose and Scope
These Terms and Conditions define the rights and obligations of Bakers’Tricks® and its customers in connection with the online sale of products offered on the website.
The applicable Terms and Conditions are those in force on the date the order is confirmed.
Bakers’Tricks® reserves the right to amend these Terms and Conditions at any time. Any amendments shall not apply retroactively to orders already concluded.
Article 2 – Products
The products offered for sale are those displayed on the website at the time of the customer’s visit, subject to availability.
Each product page describes the essential characteristics of the product concerned, including its dimensions, material and, where applicable, available personalization options.
As Bakers’Tricks® products are manufactured using, among other methods, artisanal processes and 3D printing, slight variations in appearance, finish or color may occur from one product to another without affecting their use. Photographs and illustrations are provided for illustrative purposes and shall not constitute a contractual commitment where they show minor differences that do not affect the essential characteristics of the product.
If a product becomes unavailable after the order has been confirmed, the customer will be informed as soon as possible and any amounts paid for the unavailable product will be refunded.
Article 3 – Prices
Product prices are displayed in euros (€), excluding shipping costs.
Bakers’Tricks® benefits from the French VAT exemption scheme for small businesses. VAT is therefore not applicable pursuant to Article 293 B of the French General Tax Code.
Prices may also be displayed and, where this option is available, paid in other currencies. The applicable amount is the amount displayed in the selected currency at the time the order is confirmed.
Bakers’Tricks® reserves the right to change its prices at any time. Products will nevertheless be charged at the price displayed when the order is confirmed. Applicable shipping costs are displayed to the customer before the order is finally confirmed.
For orders shipped outside the European Union, customs duties, import taxes or other charges may be imposed by the authorities of the destination country. These amounts are not collected by Bakers’Tricks® and, unless otherwise required by law, remain the responsibility of the recipient.
The customer is responsible for checking with the relevant authorities in their country regarding any applicable formalities and taxes.
Products remain the property of Bakers’Tricks® until full payment of their price has been received.
Article 4 – Orders
Orders are placed on the site bakerstricks.com.
The customer selects the products they wish to purchase and, where available, provides the requested personalization options.
The customer is responsible for checking the accuracy of all information provided before finally confirming the order, including the products selected, personalization details, quantities and shipping information. Confirming the order entails an obligation to pay.
Once the order has been confirmed, a confirmation email summarizing the order is sent to the email address provided by the customer.
Bakers’Tricks® reserves the right to refuse or cancel an order in the circumstances permitted by law, including suspected fraud, payment issues, manifestly incorrect information or a previous dispute relating to payment for an order.
Article 5 – Personalized Products
Certain products offered by Bakers’Tricks® may be made according to specifications provided by the customer or may be clearly personalized.
The customer is responsible for the personalization information provided when placing the order, including names, text, numbers or any other requested elements. The customer is responsible for checking their spelling and accuracy before confirming the order.
Unless the error is attributable to Bakers’Tricks®, an error in the information provided and confirmed by the customer shall not entitle the customer to a replacement product or refund.
The specific provisions concerning the right of withdrawal for personalized products are set out in Article 9 of these Terms and Conditions.
Article 6 – Payment
Payment is due in full at the time of order.
The available payment methods are displayed during checkout and may include payment by credit or debit card and PayPal.
The order is considered final only once payment has been accepted.
Transactions are processed by the payment service providers available on the website. Bakers’Tricks® does not have access to the confidential banking information used for payment.
Article 7 – Preparation, Shipping and Delivery
Orders are prepared and shipped within the timeframes indicated on the website at the time of ordering. Unless otherwise stated, products purchased from the Bakers’Tricks® online store are generally shipped within 2 to 4 business days. This timeframe may exceptionally be extended, particularly during periods of high activity, promotional periods or the holiday season.
Orders placed during a temporary closure of the store will be prepared and shipped when the store reopens. Any closure periods likely to affect preparation times are indicated on the website before the order is confirmed.
Depending on the destination, volume and weight of the order, shipping may be carried out using Lettre suivie, Colissimo or any other suitable shipping service. Bakers’Tricks® reserves the right to select or change the carrier used, without affecting the customer’s rights.
Where the shipping method allows, a tracking number or tracking link is provided to the customer once the order has been shipped.
An estimated delivery date may be displayed on product pages and at various stages of the ordering process. This estimate is calculated based on usual preparation and transit times and is provided for information purposes only.
This estimate may be affected by circumstances beyond the reasonable control of Bakers’Tricks®, including disruptions to transport networks, strikes, exceptional weather conditions, customs formalities or inspections, periods of high carrier activity, restrictions or disruptions affecting postal services, or any other external event reasonably beyond the control of Bakers’Tricks®.
A delay beyond the estimated delivery date resulting solely from such circumstances shall not, in itself, be considered a breach attributable to Bakers’Tricks®. However, this provision does not deprive the consumer of any rights regarding delivery under applicable law.
In accordance with Article L. 216-1 of the French Consumer Code, Bakers’Tricks® shall deliver the products on the date or within the timeframe indicated to the consumer. If no date or timeframe has been specified or agreed upon, the products shall be delivered without undue delay and no later than thirty days after the contract is concluded.
If the obligation to deliver is not fulfilled under the conditions provided by law, the consumer shall have the remedies provided for by the French Consumer Code, including the right to grant Bakers’Tricks® a reasonable additional period in which to complete delivery and, if delivery still has not occurred, to terminate the contract under the conditions provided by applicable law.
Where the delivery date or timeframe constitutes an essential condition of the contract under applicable law, the consumer may terminate the contract without first granting an additional period for delivery.
The risk of loss of or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the products.
Where the shipping method includes tracking, the tracking and delivery information provided by the carrier constitutes evidence of the shipment and delivery of the order.
Where the carrier’s official tracking information indicates that the order has been delivered to the address provided by the customer when placing the order, this information may be relied upon by Bakers’Tricks® as evidence of delivery, subject to any evidence to the contrary establishing that delivery did not actually take place.
In the event of a dispute, Bakers’Tricks® may carry out or request any appropriate verification with the carrier and request any information necessary to process the claim.
Article 8 – Returns of Undelivered Orders
a) Mainland France:
If an order is returned to us for any of the following reasons:
- Incorrect or incomplete address
- Recipient unknown at the address provided
- Mail item/package refused by the recipient upon delivery
- Mail item/package awaiting collection and not collected within the specified timeframe
A partial refund of the order will be issued upon receipt of the returned mail item/package. The refund will be calculated after deducting the original shipping costs (or, where applicable, based on the shipping costs charged by the delivery service provider, including where shipping was originally offered free of charge).
b) Rest of the World:
For orders delivered outside Mainland France, particularly those subject to customs formalities, no refund may be issued if the order is not returned to us, regardless of the reason (held by customs, refusal, failure to collect, etc.). If the mail item/package is actually returned to us, a partial refund will be issued after deducting the original shipping costs.
Article 9 – Right of Withdrawal
9.1 Withdrawal Period
In accordance with Articles L.221-18 et seq. of the French Consumer Code, where the right of withdrawal applies, the consumer has fourteen (14) days from the date on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods to exercise the right of withdrawal without having to provide any reason.
Where an order includes several goods delivered separately, the withdrawal period begins upon receipt of the last item, batch or piece.
The consumer must communicate their decision to withdraw before the expiry of this period.
9.2 Exercise of the right of withdrawal
The consumer may exercise their right of withdrawal by means of an unambiguous statement expressing their decision to withdraw.
A dedicated feature is also available free of charge on the Bakers’Tricks® website: Exercise My Right of Withdrawal.
Once the request has been submitted using this feature, an acknowledgement of receipt will be sent to the consumer by email.
9.3 Exceptions to the right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal may not, in particular, be exercised for goods made to the consumer’s specifications or clearly personalized.
This includes, in particular, cookie cutters made with personalization requested by the customer, such as a name, text, age or any other feature made specifically according to the customer’s instructions.
The right of withdrawal may also be excluded, under the conditions provided by law, for goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
Regardless of these exceptions to the right of withdrawal, where a returned product has been damaged or has depreciated in value due to the consumer, particularly as a result of use or care contrary to the instructions provided with the product, the provisions concerning depreciation set out in Article 9.4 of these Terms and Conditions shall apply. Depending on the extent of the loss in value, this may result in a reduction of the refund and, where the product has lost all value, may result in no refund being issued for the product concerned.
9.4 Return of Products
Where the right of withdrawal applies and is exercised within the statutory period, the consumer has fourteen (14) days from the date on which they communicate their decision to withdraw to return the products concerned.
Unless otherwise stated by Bakers’Tricks®, the direct cost of returning the products shall be borne by the consumer.
Products must be returned in their original packaging and properly protected to prevent damage during transit.
The consumer may be held liable for any depreciation in the value of the product resulting from handling other than that necessary to establish its nature, characteristics and conformity, in accordance with Article L.221-23 of the French Consumer Code.
Any evidence of use when the product is returned, including residues of dough or food, dirt, marks, scratches, wear or any other alteration resulting from its use, may be taken into account when assessing the depreciation in value of the product.
Where the condition of the returned product shows that it has been used beyond the handling necessary to examine it, the resulting loss in value may lead to a reduction in the refund proportionate to the depreciation identified. Where the depreciation is such that the product has lost all value, this may, where applicable result in no refund being issued for the product.
Each Bakers’Tricks® product is supplied with instructions specifying its normal conditions of use and care. In particular, consumers are informed that cookie cutters must not be exposed to a heat source or placed in an oven, microwave or dishwasher.
Any damage resulting from use or care contrary to these instructions, including any deformation caused by exposure to heat, may be taken into account when assessing the depreciation in value of the product.
Where such depreciation is attributable to the consumer, it may result in a reduction of the refund proportionate to the loss in value identified. Where the depreciation is such that the product has lost all value, this may, where applicable, result in no refund being issued for the product concerned, in accordance with Article L.221-23 of the French Consumer Code.
9.5 Refund
Where the right of withdrawal has been validly exercised, Bakers’Tricks® shall refund the consumer all amounts due, including delivery costs corresponding to the standard delivery method offered, without undue delay and no later than fourteen (14) days from the date on which Bakers’Tricks® is informed of the consumer’s decision to withdraw.
Any additional costs resulting from the consumer’s choice of a delivery method more expensive than the standard delivery method offered will not be refunded.
For sales of goods, Bakers’Tricks® may withhold the refund until the products have been recovered.
The refund will be made using the same payment method used for the original transaction, unless the consumer expressly agrees to another payment method that does not incur any additional costs.
Article 10 – Statutory Guarantees
Products sold by Bakers’Tricks® are covered by the applicable statutory guarantees, including the legal guarantee of conformity provided for by the French Consumer Code and the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
These guarantees apply independently of any right of withdrawal.
10.1 Legal Guarantee of Conformity
Bakers’Tricks® is required to deliver goods that conform to the contract. The consumer benefits from the legal guarantee of conformity where the product has a lack of conformity existing at the time of delivery and appearing within two (2) years from that date.
In the event of a lack of conformity, the consumer is entitled to have the product brought into conformity by repair or replacement, under the conditions provided by the French Consumer Code. Where these remedies are impossible or cannot be implemented under the conditions provided by law, the consumer may, in particular, be entitled to a price reduction or termination of the contract. Bringing the product into conformity shall be free of charge to the consumer.
10.2 Guarantee Against Hidden Defects
The consumer also benefits from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
This guarantee applies where the product has a hidden defect that renders it unfit for its intended use or reduces its usefulness to such an extent that the consumer would not have purchased it, or would have paid a lower price for it, had they been aware of the defect.
In such a case, the consumer may choose to return the product and obtain a refund of the purchase price, or retain the product and obtain a reduction in the price, under the conditions provided for in Article 1644 of the French Civil Code.
Any action arising from hidden defects must be brought within two (2) years from the discovery of the defect, in accordance with Article 1648 of the French Civil Code.
10.3 Exclusions Related to Product Use
Legal guarantees do not cover damage resulting from misuse of the product, improper care, failure to follow the instructions supplied with the product, or a cause external to the product.
Bakers’Tricks® cookie cutters must not be exposed to a heat source or placed in an oven, microwave or dishwasher. Deformation or damage resulting from failure to observe these precautions does not, in itself, constitute a lack of conformity attributable to Bakers’Tricks®.
These provisions neither limit nor exclude the rights granted to consumers under the applicable statutory guarantees.
Article 11 – Liability
Bakers’Tricks® is responsible for the proper performance of its contractual obligations under the conditions provided by applicable law.
Bakers’Tricks® shall not, however, be held liable for damage resulting from use of the product contrary to its intended purpose, the instructions provided or the precautions for use indicated on the website or supplied with the product.
Customers located outside France are also responsible for checking, where necessary, that the product complies with the regulations applicable in their country.
Article 12 – Intellectual Property
All elements comprising the bakerstricks.com website, including text, illustrations, photographs, graphics, creations, designs, logos and visual elements, are protected by applicable intellectual property laws.
Any unauthorized reproduction, representation, adaptation, exploitation or use of these elements is prohibited to the extent provided by law.
Bakers’Tricks® is a trademark registered with the French National Institute of Industrial Property (INPI) under number 5063727.
Any use of this trademark or its logo that may infringe the rights of its owner is prohibited.
Article 13 – Personal Data
Personal data collected when an order is placed are processed for the purposes of order management, payments, delivery, customer service and compliance with Bakers’Tricks®’s legal and regulatory obligations.
Details regarding the collection, use and retention of personal data, as well as the exercise of data subjects’ rights, are set out in the website’s Privacy Policy.
Article 14 – Consumer Mediation
In accordance with the provisions of the French Consumer Code relating to the amicable settlement of disputes, the consumer must submit a written complaint to Bakers’Tricks® before referring the matter to the consumer mediator.
If the dispute remains unresolved following this complaint, or if no satisfactory response is received, the consumer may refer the matter free of charge to the consumer mediator appointed by Bakers’Tricks®:
